1. Scope and acceptance
These Terms and Conditions apply to the Ink It Your Way website and to quotes, orders, custom stores, design services, production, installation, fulfillment, and other services provided by Ink It Your Way, LLC (“Ink It Your Way,” “we,” “us,” or “our”). By approving a quote or proof, paying a deposit or invoice, placing an order, or using our services, you agree to these terms and any additional terms shown on the applicable quote, order, invoice, proof, or store.
2. Quotes and project details
Quotes are based on the information available when prepared, including product, quantity, sizes, colors, artwork, decoration, placement, packaging, shipping, installation, and timing. Unless a quote states otherwise, pricing and availability may change before approval. Taxes, shipping, installation, rush service, artwork preparation, permits, and other charges are included only when specifically stated. If project details change, we may revise pricing and timing.
3. Artwork, proofs, and approvals
You are responsible for reviewing proofs, mockups, spelling, numbers, dates, colors, sizes, placement, and all other project details. Production may begin after approval, and approved errors are the customer’s responsibility. Screen colors, proofs, and mockups are representations; finished colors and placement may vary because of materials, production methods, lighting, displays, and normal manufacturing tolerances. Changes requested after approval may create additional charges, waste, or delays.
4. Artwork rights and authorization
You represent that you own or have permission to use every name, logo, image, trademark, design, photograph, and other material you provide. You authorize us and our production partners to reproduce those materials as needed to quote, proof, manufacture, install, and fulfill your order. You are responsible for claims arising from materials you supply without sufficient rights. Unless otherwise agreed in writing, working files, separations, digitizing, production files, templates, and shop-created methods remain the property of Ink It Your Way, while ownership of your original brand assets remains yours.
5. Products, availability, and substitutions
Products and materials may be discontinued, backordered, delayed, or changed by manufacturers without notice. We will seek approval before making a material substitution whenever reasonably possible. Manufacturer specifications, dye lots, dimensions, colors, sizing, construction, and packaging may vary. Catalog images and descriptions are provided for reference and may not perfectly represent the final product.
6. Custom production and tolerances
Custom decoration and manufacturing involve normal variation. Minor differences in ink, thread, transfer, print, cut, stitch, color, registration, placement, dimensions, finishing, and material are not defects when they fall within reasonable commercial tolerances. Exact color matching is not guaranteed unless a specific matching process is included in writing. Quantities may be subject to normal supplier or production overrun and underrun practices when disclosed for the project.
7. Customer-supplied items
Customer-supplied garments, products, artwork, files, or materials are used at the customer’s risk. We are not responsible for undisclosed defects, inconsistent construction, contamination, coatings, prior treatments, or material behavior outside our control. Reasonable spoilage can occur during setup, testing, decoration, removal, or installation. Unless accepted in writing for a particular project, our responsibility for damage to customer-supplied items is limited to the decoration charge for the affected item and does not include replacement value or consequential loss.
8. Timing and rush work
Production estimates begin after required artwork, information, approvals, products, and payments are received. Dates are estimates unless we expressly guarantee a deadline in writing. Supplier delays, shipping disruptions, weather, equipment issues, approval delays, and events outside our reasonable control may affect completion. Rush service is subject to capacity, availability, and additional charges and does not eliminate dependencies outside our control.
9. Payment
Deposits, payment schedules, credit terms, and accepted payment methods are stated on the applicable quote or invoice. We may pause ordering, production, delivery, installation, or release of goods while payment is overdue. The customer is responsible for applicable taxes and reasonable collection costs to the extent permitted by law.
10. Changes and cancellations
Change or cancellation requests must be made promptly and are not effective until we confirm them. Once artwork, labor, products, materials, outside services, or production have been ordered or started, the customer is responsible for costs already incurred plus work completed. Custom, decorated, altered, special-order, or personalized goods generally cannot be canceled or returned after production begins.
11. Inspection, claims, returns, and reprints
Please inspect orders promptly and notify us of a suspected shortage, damage, or production error as soon as practical. Keep the affected products and packaging while we review the issue. Custom products are not returnable because of preference, sizing choice, approved artwork, or normal tolerances. When we confirm that an order materially differs from the approved specifications because of our error, we will determine an appropriate remedy, which may include repair, replacement, reprint, account credit, or refund for the affected portion. No remedy may exceed the amount paid for that affected portion.
12. Shipping, pickup, installation, and storage
Shipping and delivery dates are estimates. Risk of carrier delay, loss, or damage may be subject to the carrier’s terms, and customers should report visible shipping damage promptly. Customers are responsible for accurate delivery and installation information and for safe, lawful access to the work area. Completed orders should be picked up or accepted promptly. Storage, redelivery, remobilization, or disposal charges may apply when products or sites are not ready after reasonable notice.
13. Custom stores
Store products, availability, ordering windows, fulfillment methods, delivery, returns, fundraising, and program duration depend on the individual store arrangement. Store-specific instructions control if they differ from these general terms. We may update products, close ordering, cancel unavailable items, or issue refunds when required to administer a store.
14. Website use
You may use this website for lawful business and purchasing purposes. You may not interfere with the website, attempt unauthorized access, misuse forms, introduce malicious code, scrape content in a manner that burdens the service, or use our content or branding without permission. Website content is provided for general information and may change without notice.
15. Disclaimers and limitation of liability
To the fullest extent permitted by law, services and website content are provided without warranties beyond those expressly stated in writing. Ink It Your Way is not liable for indirect, incidental, special, exemplary, punitive, or consequential damages, including lost profits, lost opportunities, or reputational harm. Our total liability related to a claim will not exceed the amount paid to us for the specific goods or services giving rise to that claim. Nothing in these terms excludes liability that cannot legally be excluded.
16. Governing law
These terms are governed by the laws of the State of Washington, without regard to conflict-of-law principles. Any dispute not resolved informally will be brought in a court of competent jurisdiction serving Snohomish County, Washington, unless applicable law requires otherwise. If part of these terms is unenforceable, the remaining provisions continue in effect.
17. Changes and contact
We may update these terms by posting a revised version with a new “Last updated” date. The version in effect when an order is approved generally governs that order.
